Russell of his 50% stock interest in Russell and Russell, Inc. The Supreme Court, New York County (Markewich, J.), denied
defendant's motion for summary judgment to dismiss the amended complaint. On appeal the Appellate Division, First Department,
unanimously reversed and granted the motion on the ground that plaintiff's action is barred by the Statute of Frauds.
